- Platform Only: Peekamoji provides a space (“Marketplace”) for users to offer, sell, and purchase items.
- Availability: Currently available in select countries; we’ll notify you as we expand.
- Additional Policies: These Terms complement our main Terms of Use, Privacy Policy, and other guidelines. If there’s a conflict, these Marketplace Terms prevail for buying/selling.
2. Compliance with App Store Policies
Peekamoji complies with Apple and Google marketplace rules. This ensures:
- Transparent Transactions: Sellers clearly display item details and terms prior to purchase.
- Return Policy: Sellers must outline refunds/returns if required by Apple/Google.
- Secure Payments: Payments happen via trusted third-party providers, not Peekamoji itself.
- Dispute Resolution: Buyers can report disputes, but Peekamoji does not mediate or provide refunds.
3. Our Role as an Intermediary
- Facilitator Only: We do not buy, sell, or process payments directly.
- No Guarantee: We are not responsible for item condition, legality, or safety.
- Independent Transactions: All sales contracts exist solely between buyer and seller.
- No Liability: Peekamoji disclaims any liability for transaction failures, undelivered goods, or defective products.
4. User Responsibilities
4.1 Sellers
- Legal Compliance: You must follow all applicable laws (e.g., consumer protection, import/export rules).
- Taxes: You handle all tax obligations (VAT, sales tax), as Peekamoji does not collect or remit taxes.
- Accurate Listings: Provide correct info (condition, price, returns).
- Payment Processing: Must use an approved third-party payment provider.
- Refund Terms: Clearly define how refunds/returns work to avoid disputes.
Consumer Rights & Return Policies
Sellers must comply with applicable consumer protection laws. If selling to EU customers, a 14-day withdrawal period may apply unless the item is exempt from returns.
4.2 Buyers
- Check Seller Policies: Before purchase, review the seller’s return/refund rules.
- Independent Agreements: You understand transactions are directly between you and the seller.
- Disputes: Non-delivery, damage, or refund failures must be addressed with the seller or payment provider.
- No Peekamoji Liability: We are not liable if the seller fails to deliver or if goods are defective.
5. Payment & Fees
- Platform Commission: Peekamoji charges a 10% commission on each completed sale to support and maintain the Marketplace.
- Transaction Costs: All extra fees (bank, currency exchange, payment processing) are deducted before the seller’s payout.
- Chargebacks & Disputes: Handled directly with your payment provider. If a chargeback occurs, Peekamoji may suspend the account and recover our lost fees.
- Failed Payments: If a transaction fails or funds are withheld, contact your payment provider. We bear no responsibility.
6. Refunds, Returns & Disputes
- Seller-Defined Policies: Each seller decides their own refund/return rules. Buyers must read these prior to purchase.
- No Peekamoji Guarantee: We do not process refunds, intervene in chargebacks, or settle disputes.
- Missing or Defective Items: Buyers must pursue resolutions directly with sellers.

- In-App Purchases (e.g., virtual goods): Refund requests go to Apple or Google.
- Physical Goods: Handled between buyer and seller.
- No Payment Processor Liability: Peekamoji is not responsible for any error, delay, or omission on third-party payment systems.
- Platform Disclaimer on Refunds: Peekamoji does not process refunds or mediate disputes. Buyers must contact sellers directly for returns or reimbursement requests.
7. Taxes & Legal Compliance
- User Liability: You, as a seller or buyer, are solely responsible for any taxes, customs duties, or import fees.
- No Remittance by Peekamoji: We do not collect, file, or pay taxes on your behalf.
- Legal Requirements: Sellers must ensure items comply with relevant regulations (e.g., safety standards, trademark rules).
- Buyer Awareness: Be mindful of potential additional charges like VAT or import duties. We disclaim any tax-related issues or penalties.
8. Prohibited Items
To maintain a safe environment, sellers cannot list products that are:
- Illegal drugs or narcotics
- Weapons, ammunition, explosives
- Counterfeit or stolen goods
- Materials promoting hate speech, violence, or discrimination
- (Any other items restricted by local laws or app store policies)
Peekamoji may remove listings or ban accounts violating these rules.
9. Disclaimers
- Shipping & Handling: We do not manage logistics, delivery, or item returns.
- Extra Fees: Payment processors may impose additional fees beyond our control.
- No Financial Liability: We hold no responsibility for transaction disputes, refunds, or claims.
10. Changes to These Terms
We reserve the right to modify or update these Marketplace Terms at any time. Changes become effective once published in the app or on our site. Your continued use of the Marketplace signifies acceptance of any revised terms.
